« Trustee Files Complaint Accusing Garrett of Wrongdoing | Main | Anson Loses Bid On Bankruptcy Venue » October 14, 2006 Trustee Files Motion For Entry of Garrett Default - - will seek sale of Garrett’s California homeAccording to newly filed court papers, the Trustee in the bankruptcy case of Jack Garrett has filed a motion seeking an entry of default against the former Four Star principal. In July, the Trustee, Alberta Stahl, filed a complaint objecting to discharge of debts by Garrett under bankruptcy protection rules. The suit accused Garrett of allegedly acting to defraud creditors. According to the Trustee’s motion for default, Garrett failed to file an answer to the Trustee’s lawsuit and its allegations of wrongdoing. In a separate action, the Trustee reached a settlement deal with one of Garrett’s largest creditors - BizNiz, LLC of Nevada. According to court records, the Nevada company made a series of loans to Garrett and former Four Star principals Ronald Anson and Mark Cohn. The company later sued all three of the former Four Star managers to recover its money. BizNiz obtained a judgment of more than $11 million and had previously attached a $3.5 million lien on a house owned by Garrett in Calabasas, California. As part of their settlement, the Trustee and BizNiz have agreed to split the proceeds from the sale of Garrett’s California home. |
