Trustee Proposes $2 Million Settlement with Anson

In late October, the Trustee proposed a settlement with Ron Anson. (See link here - warning, 3mb PDF file)

Within the proposal the Trustee states: "Based on the Trustee's extensive investigation of the Debtor's books and records, the review of documents obtained from third parties, and meetings and depositions with a number of parties, including Mr. Anson, the Trustee believes that although Mr. Anson was grossly negligent in his role as managing member of the Debtor, he did not knowingly engage in fraudulent conduct or intentionally deceive any of the investors of their money."

According to the proposed settlement document, Anson will transfer to the Trustee his right, title and interest in Red Mustang, LP (worth approximately $2.3 million, if not encumbered by any liens) as well as two entities with a partnership interest in a Phoenix hotel with an unknown value.

The proposal says, "Were I to pursue the breach of fiduciary duty case against Mr. Anson to judgment, I believe that the damages would be roughly equal to the investor loss caused by lapses in duty,....I have determined that proceeding with this settlement now is in the best interests of the estate and is the estate's only hope of realizing any value from the litigation against Mr. Anson. This is because several other creditors have long ago obtained judgments against Mr. Anson in unrelated matters and have begun taking actions to enforce their judgments against Mr. Anson and his assets."

Many investors have objected to the settlement and allege that Mr. Anson, as well as Mr. Garrett, Mr. Cohn, and other Four Star "insiders", knowingly deceived investors. A settlement hearing is scheduled on Wednesday, December 7 at 10:30 AM in Courtroom 1345, at 255 East Temple Street.

The Court would appreciate receiving any written opposition prior to the scheduled hearing, although opposition will also be accepted at the time of the hearing.
