Garrett Bankruptcy: Motion to Convert Case to Chapter 7

The Four Star Trustee has filed a motion to convert the bankruptcy case of Jack Garrett from chapter 11 to chapter 7. A hearing on the motion is scheduled for April 20th at 10:30 am in Courtroom 1345 of the Edward Roybal Federal Building and U.S. Courthouse located at 255 E. Temple Street, Los Angeles. Please keep checking back for an update on when the first meeting of creditors will be scheduled.

One of the largest creditors in the Garrett case, Credit Suisse First Boston Mortgage Capital, has joined the Four Star Trustee in support of converting the bankruptcy to chapter 7. In a recent court filing, CSFBMC detailed many reasons for its support of chapter 7, and argued for the appointment of an independent Trustee. Here's an excerpt:

"Nothing about the Debtor's (Garrett's) conduct before or during this case indicates that he can be trusted to investigate his own affairs and bring actions against potential insiders (including his wife). Furthermore, Mr. Garrett is one of the principals of Four Star, has been sued by the Four Star trustee for breach of fiduciary duty in that action, and is under investigation by federal authorities in connection with his role in Four Star. Under the circumstances, converting the case to chapter 7 and allowing an independent trustee to investigate the Debtor's affairs would benefit the estate much more than employing counsel at estate expense to do the Debtor's bidding to deny, delay and obfuscate."

Garrett's bankruptcy was recently transferred from Florida to the U.S. Bankruptcy Court Central District California in Los Angeles.
