« Animation Cel and Sports Memorabilia Update | Main | Garrett Bankruptcy: Motion to Convert Case to Chapter 7 » February 16, 2005 Judge to Garrett: Transfer Bankruptcy to CaliforniaThe judge presiding over Four Star’s bankruptcy has ruled that former Four Star President Jack Garrett's personal bankruptcy case must be transferred from Florida to California. Garrett relocated to Florida where he filed for bankruptcy last November. Bankruptcy laws in Florida are considered favorable to debtors. Garrett is appealing U.S. Bankruptcy Judge Thomas Donovan’s ruling. In a court filing, the Four Star Trustee called Garrett's challenge to transfer of his bankruptcy from Florida to California an "artificial attempt to invoke judicial protection in a forum thousands of miles away from the largest concentration of his creditors." According to court documents, former Four Star principals Mark Cohn, Ron Anson and Jack Garrett have existing judgments against them totaling in the tens of millions of dollars. One of the largest creditors, Credit Suisse First Boston Mortgage Capital, has an existing court judgment of nearly $17 million. CSFBMC's judgment stemmed from a loan it made in a hotel deal engineered by Cohn, Anson and Garrett that ended up in bankruptcy. To read more court filings by the Trustee, please click here. |
